Who we are

Noir Digital Agency ("Noir", "we", "us") is a digital agency based in Mumbai, Maharashtra, India. For the purposes of the Digital Personal Data Protection Act, 2023, we are the Data Fiduciary for the personal data described here.

We do not knowingly collect sensitive data, and we ask you not to include it in forms or messages.

We process your personal data on the basis of your consent, which you give by ticking the box on each form, by booking a call, or by contacting us directly. Consent is specific to the purpose shown next to the box. You can withdraw it at any time by contacting us (details below), by unsubscribing from emails. Withdrawing consent does not affect anything we did before you withdrew it.

Cookies and analytics

The site uses Google Analytics 4 to count visits and see how pages are used. It uses Google Consent Mode:

  • Visitors in the European Economic Area, the UK and Switzerland: analytics cookies stay off unless you click Accept.
  • Visitors elsewhere: analytics is on by default, and you can switch it off at any time using the cookie banner.
  • Advertising features and ad personalisation are switched off for everyone.

We keep analytics data for no longer than 14 months. Your choice is saved in your browser's local storage so we don't ask again. We use no other tracking cookies.

Who we share it with

We never sell or rent your data. We use a small number of service providers ("Data Processors") who handle data only on our instructions:

  • Netlify: hosts the website and receives form submissions.
  • Google: Google Analytics (as described above).
  • Cal.com: online booking for strategy calls.
  • WhatsApp (Meta): if you choose to message us on WhatsApp.
  • Email and productivity tools we use to reply to you and store project records.

We may also disclose data if the law requires it.

Where your data is stored

Some of these providers store data on servers outside India, for example in the United States or the European Union. Transfers are made as permitted under the DPDP Act and any restrictions notified by the Government of India.

How long we keep it

  • Enquiries, audit reports and booking records: for as long as we are discussing or working on a project with you, then up to 24 months after our last contact, unless the law requires longer (for example, invoices and tax records).
  • Newsletter: until you unsubscribe.
  • Analytics: no longer than 14 months.

When data is no longer needed, we delete it or make it anonymous.

Your rights

Under the DPDP Act you can ask us to:

  • tell you what personal data we hold about you and how we use it;
  • correct, complete or update it;
  • erase it, where we no longer need it or you withdraw consent;
  • nominate someone to exercise these rights on your behalf if you die or become unable to;
  • resolve a grievance about how we handle your data.

Contact us using the details below and we will respond as soon as we can. If you are not satisfied with our response, you may complain to the Data Protection Board of India.

Children

This website is meant for businesses and is not directed at anyone under 18. We do not knowingly collect personal data from children.

Security

We use reputable providers, encrypted connections (HTTPS) and limited access to protect your data. No system is perfectly secure; if a breach affecting your data occurs, we will inform you and the Data Protection Board as the law requires.
